 Empty Playlists!?!?

Here's the problem:

1. I create a smart playlist

2. Play the list on the iPod

3. When I go back to the list the songs that have played are no longer on the list. They are still on the iPod but not part of the smart playlist. So if I have 20 songs on the original list and I stop the iPod after playing song #10, once I turn the iPod back on there are only 10 songs remaining and song #10 is now #1.

4. What is up with this?

5. I've done everything possible from calling Apple Care to uninstalling and reinstalling software, restore the iPods. I have two (20 & mini) and the same thing happens.

Any suggestions or help would be greatly appreciated!

What are the criteria on the Smart Playlist? It's possible that the combination of Live Updating and, say, Play Count criteria would cause songs to disappear from the list after they have been played.
